Custom and Personalized Flies Policy and Terms

The following lists the policy and conditions which govern the terms of the custom and personalized fly tying services offered by ArtsNFlies.com.

Your Request for Custom Tying Services

Requests for custom fly tying or personalized flies are initiated from our Custom Flies page. This is only a request to begin discussions about creating a custom or personalized fly order. It is not an order or commitment by ArtsNFlies.com or our fly tier to produce flies.

A "personalized fly" is a request for a slight modification* to a fly pattern already available from the ArtsNFlies.com online catalog. This may include such things as hook size, extra flash/no flash, more/less weight, different color eyes, etc.

A "custom fly" is a requests for a fly pattern not offered on the ArtsNFlies.com online catalog*.

(*in all cases ArtsNFlies.com reserves the right to make the final decision as to whether a request is for a personalized fly or a customer and to bill accordingly.)

Please note: All requests for custom or personalized fly tying services, whether initiated from this page, via email, postal mail, voice, etc. are still bound by the terms listed on this page.

What you need to provide for the service

Our fly tier requires some direction from you as to how you wish your flies to be made. You can specify any aspect of the fly including the patterns and/or style, hook size and/or type, colors, materials to be used for the tie and any weights.

Additionally, you may be asked to provide a picture and/or URL address to a picture of an example of the fly to be created. You may also be asked to provide a physical sample of the fly to be made. The sample will be used to guide our fly tier when making your flies and will be returned to you when your order is shipped. If a sample has been sent for a request that later does not result in an order for custom or personalized flies ArtsNFlies.com will return your sample at no charge for shipping. ArtsNFlies.com is not responsible for the loss or damage of samples sent to us or returned to you.

What we will provide

ArtsNFlies.com's fly tier will provide his knowledge and skills from over 30 years of fishing for producing your requested flies. Our fly tier is free to use his own judgment and opinion for making the final decisions about any details of the custom or personalized fly request. You agree to accept our fly tiers decisions in these matters.

Minimum order

There is a six(6) fly minimum on any custom or personalized fly order.

Pricing & Shipping

Before work on a custom or personalized fly order begins ArtsNFlies.com will quote a price for the entire order. The quote will itemize the flies being requested, shipping&handling. Sales tax will be added (if applicable). The quote will include instructions for sending your payment to ArtsNFlies.com. Since each request for a custom fly or personalized fly is different, the price will be determined based on factors including but not limited to the pattern/style requested, quantity, materials used, complexity of the fly and time to make.

Unless you specify otherwise, ArtsNFlies.com will ship your custom or personalized flies order by our standard shipping method. You may request an alternative shipping method from our list of shipping options.

The quoted price is good for 2 weeks (14 calendar days) from the date it is issued. You must reply to accept the price and place the order within that time. After that time period, ArtsNFlies.com reserves the right modify or alter the quote in any way. Further, if multiple quotes or a series of quotes are provided, only the most recent quote will be honored and will supercede any previous quotes. The 2 weeks are counted from the date the most recent quote is provided.

Payment

You may use any payment option acceptable to ArtsNFlies.com.

For customers paying by credit card, ArtsNFlies.com reserves the right to charge a 50% non-refundable deposit for each custom fly order before your order can be acted upon.

For customers paying by check, money order or Pay Pal payment in full is required before your order for custom or personalized flies can be acted upon. 

ArtsNFlies.com gift certificates may be applied to custom or personalized fly orders.

Discounts and/or coupons cannot be used for custom or personalized fly orders.

Order Cancellation

If you cancel all or part of your order for custom or personalized flies after payment has been received by ArtsNFlies.com a merchandise credit will be issued in accordance with our policy on payment options. Additionally, ArtsNFlies.com reserves the right to charge a 50% cancellation fee on a custom or personalized fly order to cover the cost of any materials already used in preparing your order or that have been purchased by ArtsNFlies.com in presumption of your order (for orders secured with a credit card your account will be charged this fee upon cancellation).

If all or part of your order for custom or personalized flies is cancelled by ArtsNFlies.com after payment is received we will issue a refund for the full amount of your remitted payment (or prorated amount if the order is only partially cancelled).

If an order is cancelled by either yourself or ArtsNFlies.com after payment has been sent but before it has been received we will return your payment unprocessed. We are not responsible for lost or misdirected payments.

Any further costs and/or expenses other than the amount of the order incurred by you for placing a customer or personalized fly order (including but not limited to sending examples of flies, special materials or instructions) will not be credited or refunded.

Waiver of Liability and General Release

This custom and personalized flies services is provided "as is" by ArtsNFlies.com and without any promises, warranties and/or guarantees in regard to the service or products rendered. This includes but is not limited to accuracy of fulfilling your request, the quality and/or durability of the flies tied or the materials used, and/or the fishing catching ability of the flies.

By submitting a request for custom or personalized fly tying services you agree to "hold harmless" ArtsNFlies.com, it's owners, employees, official representatives, and their assigns from any claims resulting from such a request and/or order, including but not limited to copyright infringement, intellectual property rights, physical injuries, or any other damages or "Acts of God". Further, you agree to "hold harmless" and fully accept the judgment and opinion of our fly tier for making decisions about any details of the custom or personalized fly request.

Unless otherwise specified and agreed to in writing, the patterns styles and/or recipes provide by you for custom or personalized flies belong to ArtsNFlies.com without exception. ArtsNFlies.com reserves the right, at our discretion, to add a custom or personalized fly pattern to our fly catalog as a regular product offering. If a custom or personalized fly is add to our catalog as a regular product offering no payment or consideration in any form will be made to the person(s) who provided the patterns styles and/or recipes for such offering(s) or to the person(s) who had previously requested the fly as through a custom or personalized fly order.

You recognize and accept that once payment has been received and work on your custom or personalized flies order begins it may not be possible to change or alter your request. The decision to accept a change or alternation to a custom or personalized fly order is made by our fly tier who is the sole arbiter.

Custom flies may not be repackaged and/or resold (including but not limited to raffles, auctions and give-aways) without the prior express written permission of ArtsNFlies.com.

No part of this agreement shall be considered a contract, exclusive agreement or commitment to perform a service and/or provide a product. ArtsNFlies.com reserves the right to deny or cancel any request for custom or personalized flies at any time for any reason.

ArtsNFlies.com is not responsible for the damage, loss and/or misdirection of flies sent to us as samples or for orders shipped by us to customers.
